    1. Spain had argued that Junqueras would only become an MEP when he took an oath in Madrid, and then refused to allow him out of pre-trial detention to take that oath.     The #ECJ's second point was that Junqueras is entitled to immunity as a MEP, specifically listing the immunity to travel to the first session of the new EU parliament. Spain refused this.

      The third point is that the immunity to travel 'entails' that Spain lifts the provisional detention, and that if Spain doesn't want to do that, then it must ask the EU parliament to waive the immunity.

        The next move is Spain's: it must comply and release Junqueras or argue for the supremacy of Spanish law over the EU treaties and laws to which it has signed up.

          Spain, however, is consistently at the top of the charts for failure to comply with EU law. As it has done in the past in cases related to Catalonia and the Basque Country, amongst others, it may simply choose to ignore the ruling.
